I have applied for OPT application (applied first time) in second week of May @ Vermont Service Center.

In last week of June, my employer filed H1B visa via premium processing and it gets approved within a week. H1B start date is Dec 1, 2010.

Last week, I received RFE for my OPT application stating that my status has changed to H1B. Please provide approval receipt. I have sent the approval receipt to USCIS. Current online status of OPT application shows that USCIS office received requested documents and my case is pending.

1. Will it affect my OPT application?

2. My original joining date is already postponed by 2 weeks. Still I am waiting for OPT card. Should I request expedite processing of my OPT application? or should I wait?

Please let me know. Thanks.

I know a friend who has done Bachelors in Computer Application in india. She is now in US and wanted to know the options for working or studying in US.

Is she eligible to take up MS degree..???
Is she eligible for H1b..???

I have a break period of 4.5 months. May 15 - Oct 1st. I was wondering if its OK if I just take a course in fall or should I enroll for summer as well. My grace period will end Jul 15th but by that time I should have an I-20 with me for Fall. Is that fine?

My attorney filed I-140 on July 5th. No receipt yet. No news also.

He said he cannot send it to TSC, instead he mailed it to NSC. Is that the standard filing place?

Do you have a notice for your standalone I-140 filed at NSC on or after July5th.

I filed 485 on July 2nd with an EAD with receive notice date of march 2007. it is not approved yet. Will I get an EAD even before the I140 is approved or should the I140 be approved for the EAD to be issued.

Hi

I am transferring my H1 to a firm on full time basis(not consulting company, product based). Currently I am on a project with A and I am going to transfer my H1 to B (which is 6 yrs old, american based company). I have pay slips from past 4 months, and I was on bench for 2 months where I didnt get my pasylips. For transfer I gave my past 4 months pay slips.

I have 2 questions here.

1) With company A, my LCA was not accurate. My LCA was of NY state & I am working in NJ.
Will this create any issue for my H1 transfer with company B which is VA and they have got the approved LCA.

2) Will there be any issue with my 2 months pay slips (which are of July & Aug). Right now I have submitted my H1 transfer with past 4 months payslips (Sep,Oct, Nov & Dec).

Please advice, I will really appreciate your suggestions on this ASAP.

My aunt (father�s sister) is separated (not divorced) from her husband for over 17 years now. She and her 24 year old son (who was 7 years old when his parents separated) live with our family for last 17 years. Her application for visitor visa was rejected in year 2003 when I had invited her to attend my graduation ceremony. At that time I had not sent a sponsor letter. under OPT you are still on F1 Visa...If you join another degree, you can still have F1, I believe you just need to inform the university on which your visa was issued about the university transfer. International affairs at your new univ. should help in this regard.
